空爆が始まってから9日が経ちますが、攻撃の手は緩まることなく、ガザでは極限を超えた状況が続いています。水も食料も不足し、医療物資や電力の不足に加えて、イスラエル軍による強制的な移動勧告により、空爆で逃げ惑う230万人のうち、70％もの人が医療にアクセスできない状況となっています。また、勧告に従い、南部に移動した人々に対しても引き続き空爆を行い、ますます死傷者が出ています。

そんな中、JVCも加盟しているパレスチナで活動する国際NGOの連合体AIDA（国際開発機関協会）が、イスラエル軍の国際法違反について、声明を発表しました。

JVCもこの声明に賛同します。

AIDAは、ガザ地区において8日間連続で双方向の攻撃が続いている事態の深刻さを深く憂慮し、緊急に警告を発します。 2023年10月14日12時現在、ガザ地区では2,215人のパレスチナ人が死亡し、8,714人が負傷しています。

この壊滅的な状況の中、ガザ内の40万人が家を追われています。イスラエル軍がガザ市を含む北部の110万人のパレスチナ人に対して（南部に）退避するよう与えた24時間の猶予はすでに過ぎており、ガザの人々の命は差し迫った危険にさらされています。破壊されたインフラの中、100万人以上のパレスチナ人に自宅からの脱出を強いることは、無人偵察機（ドローン）を頭上に見ながら徒歩で逃げることにつながり、完全な混乱と恐怖を生み出しています。

このような命令が出された後も、パレスチナの市民や民間の建物が（空爆）の標的にされており、退避することによる身の安全の確保が担保されていないことが、人々を家にとどまらせています。  移動を強要し、ガザを完全に包囲し、必要な物資の供給を妨害する（イスラエルの）行為は、住民全体に対する集団的懲罰(※1)です。またその約半数は子どもたちです。これらの措置は、国際人道法（IHL）に基づく民間人の保護に違反し、ガザにおけるこの前例のない人道危機を悪化させていると共に、国際社会の明確な立場を無視し、あまたの安全保障理事会やその他の国連決議に明白に違反しています。(※2)

病院はパンクし、電気は不足し、医薬品も食料も枯渇し、給水システムは損傷しています。安全や帰還の保証のないこの強制的な移動と、本来保護されるべき人々のニーズに応得ておらず、国際人道法の重大な違反かつ戦争犯罪である「強制移動」にあたる重大な懸念があります。

(※1)そのグループのメンバーによって犯されたとされる行為に対してそのグループに課される罰または制裁のこと。

(※2) 武力紛争の際に適用される原則や規則を網羅したもので、そうした事態に遭っても人道を基本原則として掲げ、紛争当事者の行為を規制する。文民、負傷者や病人、戦争捕虜のような人々の保護について規定し、また軍事作戦を行う際の手段や方法を規制する。

AIDAは、被災住民の安全とウェルビーイング(※3)を確保するため、イスラエルが国際人道法上の義務を遵守し、この命令を即時撤回することを緊急に求めます。 AIDAは、事態の深刻さに警告を発し、国際法を遵守しこれ以上の苦痛と人命の損失を回避するために、民間人の保護を優先し、ジュネーブ第4条約に概説されているように、その存在の本質である人間の人格と尊厳の尊重を確保することを明確に要求します。

(※3)身体的、精神的に健康な状態であるだけでなく、社会的、経済的に良好で満たされている状態にあることを意味する概念。

AIDA statement on Gaza situation - 14 October 2023

The Association of International Development Agencies (AIDA) is deeply concerned and urgently warns against the gravity of the situation and ongoing hostilities in the Gaza Strip for eight consecutive days.  As of 14 October 2023, 12p.m. 2,215 Palestinians have been killed and 8,714 injured in the Gaza Strip. 

Amidst this catastrophic situation, where 400,000 people have been displaced from their homes, the Israeli military forces have issued an order for 1.1 million Palestinians to forcibly relocate from northern Gaza within a 24-hour timeframe, time already elapsed, putting their lives at imminent risk. Forcing over one million Palestinians to escape from their homes amid destroyed infrastructure is leading them to flee on foot, with drones overhead, creating utter chaos and fear. Even with these orders, Palestinian civilians and civilian objects are being targeted, leaving no one safe, and causing more civilians to hold back and not trust reassurances of safety with relocation.   The actions of forcing relocation and imposing a total siege on Gaza, obstructing essential supplies, constitute collective punishment for the entire population, approximately half of whom are children. These measures violate protections for civilians under International Humanitarian Law (IHL) and worsen the already unprecedented humanitarian crisis in Gaza, showing a disregard for the clear position of the international community and a blatant violation of numerous Security Council and other U.N. resolutions.

Hospitals are overwhelmed, electricity is scarce, medicine is running out, food supplies are depleting, and water systems are damaged. The forced relocation, without guarantees of safety or return and a failure to address the needs of the protected population, raise significant concerns of potential forcible transfer, constituting a grave breach of IHL, amounting to a war crime. AIDA urgently calls for the immediate 

rescindment of this order, emphasizing Israel's obligation under IHL to ensure the safety and well-being of the affected population.  AIDA warns of the gravity of the situation and unequivocally call for upholding international law and prioritizing the protection of civilians to avert further suffering and loss of human life, ensuring respect for human personality and dignity, which are the essence of its existence, as outlined in the 4th Geneva Convention.
